1. Definitions
Heartland Insulation Limited (“we”, “us”, “our”): the company supplying insulation products and services.
Customer (“you”, “your”): the individual or organisation requesting or accepting our products or services.
Services: insulation assessment, installation, removal, advice, and associated labour.
Products: insulation materials and any items sold in connection with our services.
2. Acceptance of Terms
These Terms and Conditions apply to all services and sales provided by Heartland Insulation Limited. By accepting a quotation, paying a deposit, or engaging our services, you agree to these Terms and Conditions.
3. Quotes and Pricing
- Written quotes are valid for 30 days unless otherwise stated.
- All prices exclude GST unless clearly specified.
- Quotes are based on the information provided. Additional costs may apply if job scope changes (e.g. access issues, hidden damage, or additional areas).
- We reserve the right to withdraw or amend a quote before acceptance.
4. Deposits and Payment
- A 50% deposit is required before work is scheduled or materials are ordered.
- The balance must be paid within 7 days of completion or invoice date, whichever comes first.
- Payments not received by the due date may incur interest at 2% per month, plus any debt recovery costs.
- Work may be delayed or suspended if payments are not made as agreed.
5. Refunds
- Deposits are non-refundable once materials have been ordered or labour has been allocated.
- If a refund is approved, it will be processed on the last business day of the month.
- Refunds will be made to the original payment method unless otherwise agreed in writing.
6. Scheduling and Completion
We will use reasonable skill and care to complete work within agreed timeframes. Delays caused by weather, supply issues, site inaccessibility, or other events outside our control are not our responsibility. Revised schedules will be communicated as required.
7. Compliance and Standards
We comply with all applicable New Zealand Building Code requirements, health and safety regulations, and industry best practice (NZS 4246). Customers are responsible for obtaining any necessary consents or approvals unless otherwise agreed.
8. Guarantees and Warranties
- All work is covered by a 12-month workmanship warranty.
- Products carry manufacturer warranties, which may range from 10 to 50 years depending on the brand.
- The Consumer Guarantees Act 1993 applies to all services and products.
9. Cancellations and Rescheduling
- Cancellations within 48 hours of scheduled work may incur charges for labour allocation or materials purchased.
- We may reschedule work for reasons of health and safety, site conditions, or force majeure events.
10. Ownership of Goods
All materials remain the property of Heartland Insulation Limited until full payment has been received. We reserve the right to remove unpaid materials and may register a security interest under the Personal Property Securities Act 1999.
11. Liability
Our liability is limited to the total value of the products or services provided. We are not liable for indirect, consequential, or financial loss outside the scope of our work.
12. Dispute Resolution
If a dispute arises, both parties agree to attempt resolution in good faith through direct negotiation or mediation. If unresolved, the matter may be referred to the Disputes Tribunal or the courts of New Zealand.
13. Governing Law
These Terms and Conditions are governed by the laws of New Zealand. Any disputes are subject to the jurisdiction of New Zealand courts.
